BUYER REWARDS PROGRAM PERIOD
The BestRide.com Buyer Rewards Program (the “Rewards Program”) begins at 12:01 a.m. Eastern Time (“ET”) on March 28, 2016 and will continue until terminated upon at least thirty (30) days’ notice, such notice to be provided by the posting of updated Terms and Conditions on BestRide.com (the “Program Period”).
1. The Rewards Program is open only to legal residents of the United States who are eighteen (18) years of age or older at the time of entry (the “Individual” or “Individuals”) and business entities purchasing up to five (5) vehicles in a calendar year (the “Business” or “Businesses” and, together with the eligible Individual, “Participant” or “Participants”). 2. Participants must comply with all of the following, as verified by BestRide.com: (1) find a new or used vehicle on BestRide.com, (2) save the vehicle search to Participant’s BestRide.com account, and (3) purchase that new or used vehicle from a Bestride.com participating dealer (or an alternate vehicle so long as it was found through BestRide.com and purchased from a Best.Ride.com participating dealer) (a “Vehicle”). 3. Purchase of a Vehicle by Participant must be during the Program Period. 4. Employees, contractors or interns of GateHouse Media, LLC or Propel Business Services, Inc. d/b/a Bestride.com (together, “Bestride.com” or “Sponsor”), BestRide.com participating dealers (the “Dealer” or “Dealers”), the merchants who are providing gift cards for the Rewards Program (the “Merchants”), and each of their respective divisions, affiliates, parent companies, subsidiaries, and advertising and promotion agencies and immediate family members of any of the foregoing are not eligible to enter the Rewards Program. For purposes of this Rewards Program, “immediate family members” is defined as spouses, siblings, parents, children, grandparents and grandchildren, whether as "in-laws", or by current or past marriage, remarriage, adoption, co-habitation or other familial extension, and any other persons residing at the same household location, whether or not related. In order to enter the Rewards Program or earn a Reward (as defined below), Participant must comply fully with these Terms and Conditions (the “Terms and Conditions”), and by entering agrees to be bound by these Terms and Conditions and the decisions of Sponsor, whose decisions shall be binding and final in all respects.
HOW TO ENTER THE REWARDS PROGRAM
1. Participant must enter online at www.BestRide.com/rewards (the “Website”) during the Program Period, follow the on-screen instructions, complete the requested contact information and read and agree to these Terms and Conditions (the “Entry” or “Entries”). By filling out an Entry, Participant authorizes Sponsor to contact the dealer designated in the Entry to verify purchase of a Vehicle and to share any information provided by Participant for such purpose. 2. Participants are allowed one (1) Entry per Vehicle during the Program Period. Participants may qualify for more than one (1) Reward, and submit more than one (1) Entry to the Rewards Program, by buying more than one (1) Vehicle during the Program Period, but no more than five (5) Vehicles in a calendar year. Purchase of a Vehicle jointly by more than one party will only qualify for one (1) Reward for that Vehicle, and the Reward will be issued to the Participant submitting the Entry. Duplicate Entries for the same Vehicle will be disqualified. Any attempt by a Participant to obtain more than the stated number of Entries will void such Entries and that Participant may be disqualified from this Rewards Program. 3. Entries for the Rewards Program will not be accepted through e-mail, phone, facsimile, postal mail, express delivery services or hand-delivery to the offices of any of Sponsor’s affiliates participating in this Rewards Program. 4. Participant must submit an Entry within 180 days from the date of Vehicle purchase or the Vehicle purchase will not be eligible for any Reward. 5. By participating in this Rewards Program, Participants agree to opt-in to receive e-mail communications from Bestride.com. If Participants choose to opt out of such future communications from Bestride.com, they will be able to do so by following the instructions on any electronic communications sent by Bestride.com. Upon opting-out, Bestride.com will no longer send e-mail messages to the Participant. Participant’s choice to opt out will not affect the Participant’s receipt of a Reward, if eligible.
NOTIFICATION TO PARTICIPANTS
1. A Participant will be notified within three (3) business days after the submission of an Entry (in accordance with the contact information supplied by Participant at the time of Entry) as to whether BestRide.com was able to verify the purchase of a Vehicle, or whether additional information is required (the “Reward Notification”). BestRide.com is not responsible for typographical errors or other inaccurate information provided by a Participant. 2. If Participant does not respond to the Reward Notification within fifteen (15) days after the Reward Notification was made, Bestride.com may in its discretion void Participant’s Entry and require resubmission of a new Entry. 3. If Participant does not provide information enabling BestRide.com to verify the purchase of a Vehicle, or the applicable participating Dealer does not validate the purchase, Participant will not be eligible for any Reward. It is solely Participant’s responsibility to communicate with the Dealer from which the Vehicle was purchased to ensure that the Dealer has record of the Vehicle purchase and to ensure Dealer timely responds to any attempts to verify Vehicle purchase. Sponsor is not responsible for any missing, inaccurate or false information provided by any Dealer or any Participant.
1. A Participant who has submitted an Entry and is confirmed to be eligible for a Reward based on verification of Vehicle purchase is deemed the “Buyer.” The Buyer will be awarded gift cards from Merchants selected by BestRide.com in its sole discretion (the “Reward”). 2. One (1) Reward will be awarded for each verified and qualified Vehicle purchased in this Rewards Program. The maximum value of the Reward, as determined by the face value of the gift cards constituting the Reward, is $500. Rewards may not be exchanged, traded in for cash or substituted for other Merchant gift cards different from those provided by BestRide.com. 3. The Reward will be awarded subject to verification of the Vehicle purchase and Participant’s compliance with these Terms and Conditions. 4. No substitution, assignment or transfer of the Reward will be allowed, except at the sole discretion of BestRide.com. BestRide.com reserves the right to substitute Rewards of equal or greater value should the featured Reward, or any elements thereof, become unavailable. The Reward may not be redeemed for cash at any time. All local, state and federal taxes incurred by accepting a Reward will be the sole responsibility of the Buyer. 5. All costs and expenses related to use of the Reward and not specified herein as being included in the Reward, are the responsibility of the Buyer and include, but are not limited to, taxes, Merchant transaction or other fees, etc. 6. Sponsor has not made and Sponsor is not responsible in any manner for any warranties, representations or guarantees, express or implied, in fact or law, relating to the Rewards, regarding the use, value or enjoyment of the Rewards, including, without limitation, merchantability or fitness for a particular purpose. Sponsor is not responsible in any manner for any issues relating to use, redemption, loss or theft of the Reward or for any disputes the Buyer has or may have with any Merchant relating to the Reward or any products or services purchased through use of the Reward.
GIFT CARD TERMS AND CONDITIONS
No compensation will be given for lost, stolen, mutilated or expired gift cards. Sponsor is not responsible for replacing lost, stolen, mutilated or expired gift cards. Fulfillment of gift cards is the sole responsibility of the Merchant, not Sponsor, and is only redeemable at the specified locations. The gift card must be surrendered upon redemption and no photocopies or reproductions will be honored. All gift cards included in a Reward are subject to the terms and conditions regarding use, loss, theft, and redemption and all other terms and conditions established by the Merchant providing that gift card. Any questions or issues that a Buyer has regarding Merchant gift cards must be directed to the Merchant customer service center, and will be handled exclusively by the Merchant. All transactions, disputes, questions, and all other aspects of the relationship between any Buyer and Merchant are solely the responsibility of Buyer and Merchant, and Sponsor and its affiliates have no responsibility for any such matters.
By entering this Rewards Program, Participant agrees to comply with these Terms and Conditions and the decisions of Sponsor, which are binding and final, and release Sponsor, Dealers and Merchants, and each of their respective divisions, affiliates, parent companies, subsidiaries, advertising and promotion agencies and anyone associated with the production of this Rewards Program, and their respective directors, officers, employees and agents from any and all liability for any claims, injuries, losses or damages (including attorneys fees) of any kind arising out of their participation in this Rewards Program or resulting from acceptance, possession, use, misuse or inability to use any Reward or their interaction with any Merchant. Each Participant and Buyer waives the right to assert as a cost of winning the Reward any and all costs of verification and redemption or travel to redeem said Reward and waives any liability or claims (including attorneys fees) which might arise from redeeming or seeking to redeem said Reward. In the event of non-compliance with these Terms and Conditions, or if a Reward Notification is returned to Sponsor as undeliverable, if Reward is refused or cannot be accepted for any reason, the Reward will be forfeited. Upon forfeiture or refusal, no compensation will be given. Acceptance of a Reward constitutes permission (except where prohibited) for Bestride.com and its affiliates to use the Buyer’s name, photograph, likeness and/or statements attributed to the Buyer regarding the Rewards Program, for any and all public relations, advertising and/or promotional purposes as determined by Bestride.com, without further notice, consent, review or approval or further compensation. All Entries become the property of Sponsor. This Rewards Program shall only be construed and evaluated according to the laws of the state of New York, without regard to the principles of conflicts of laws and submission of any entry constitutes acceptance of such laws. This Rewards Program is void where prohibited. All federal, state and local laws and regulations apply. Sponsor and its affiliates reserve the right to use any and all information related to the Rewards Program, including information on Participants obtained through the Rewards Program, for marketing purposes or any other purpose, unless prohibited by law. BESTRIDE.COM BUYER REWARDS PROGRAM TERMS AND CONDITIONS Sponsor and its affiliates reserve the right to change the Terms and Conditions of the Rewards Program at any time by posting updated Terms and Conditions to BestRide.com. A Participant’s participation in the Rewards Program after the posting date of revised Terms and Conditions signifies notice and agreement to the revised Terms and Conditions.
